States and Indian tribes may reclaim problems created by non-coal mining if:
A. They are "Certified" that they have addressed all thier coal-related problems. The Hopi, Louisiana, Montana, Navajo, Texas, and Wyoming are "Certified." (SMCRA, SEC. 411)
B. If at the request of a State or Indian Tribe, the Secreatary of the Department of the Interior determines such problems could endanger life and property, constitute a hazard to the public health and safety, or degrade the environment. (SMCRA, SEC. 409). Some western States and Indian tribes with many very hazardous problems created by non-coal mining have used this provision to reclaim these problems.
Over 60 percent of the non-coal reclamation has been in Wyoming. Significant amounts have also been accomplished in Colorado, Montana, Texas, Utah, and in the Navajo Nation.
