S7409 Mr. ROBERT C. BYRD. Mr. President, at the request of Mr. METCALF, and on behalf of the Committee on Energy and Natural Resources, I report an original resolution with respect to the consideration of S. 7.

S7409 Resolved, That pursuant to section 402(c) of the Congressional Budget Act of 1974, the provisions of section 402(a) of such Act are waived with respect to the consideration of S. 7, a bill to provide for the cooperation between the Secretary of the Interior and the States with respect to the regulation of surface mining operations, and the acquisition and reclamation of abandoned mines and for other purposes. Such waiver is necessary to allow for authorization of FY 1977 funds for use by the Secretary of the Interior to assist State regulatory agencies to improve their enforcement capabilities in line with the requirements of the interim implementation program established in the Act.
