 Freedom of Information Act (FOIA)



The information contained in this guide is intended to supplement the information on the Department of the Interior's (DOI) FOIA home page. It is not exhaustive or definitive. Further, to the extent that anything in this guide may be or could be construed as inconsistent with the law or DOI's regulations, the law and regulations will control this agency's responsibilities under the FOIA.
INTRODUCTION
This reference guide is intended to assist you in making Freedom of Information Act (FOIA) requests for Office of Surface Mining records. The Department of the Interior FOIA regulations are set out in 43 CFR Part 2. The Department of the Interior FOIA Handbook at 383 DM 15 and the Office of Surface Mining FOIA Directive INF-3 describe our FOIA procedures. Because the Electronic FOIA Amendments of 1996 takes effect in stages, this reference guide will be revised as further changes in our FOIA procedures are implemented.

You may also wish to review "A Citizens Guide on Using the Freedom of Information Act and the Privacy Act of 1974 to Request Government Records," available through the Government Printing Office (GPO); and the FOIA fee schedule and guidelines published by the Office of Management and Budget, at 52 Fed. Reg. 10012 (March 27, 1987).

These reference materials are accessible to you via the Interior Department's and Office of Surface Mining's home pages; as well as the Government Printing Office home page at http://www.access.gpo.gov/nara/cfr, which contains the Federal Register and Code of Federal Regulations. Paper copies can be obtained by contacting the Office of Surface Mining FOIA Officer or the Government Printing Office.
