Library of COALEX Research Reports

COALEX Research Reports are the products of research and analysis conducted on specific issues relating to the regulation of Surface Mining Control and Reclamation Act of 1977. The research is conducted in response to requests for information from State Regulatory Authorities, under a cooperative agreement between the Office of Surface Mining (OSM) and the Interstate Mining Compact Commission (IMCC).

COALEX refers to the Library of Surface Mining Materials maintained by OSM in LEXIS-NEXIS and is a major source for the research.

TOPIC: DURATION OF MINING PERMITS FOR NON-FUEL MINES

INQUIRY: What is the normal duration of mining permits for non-fuel mines (1 year, 5 year, life of mine, etc.), renewal procedures (automatic, administrative review, technical review, etc.) and any fees associated with permit renewals?

SEARCH RESULTS: Research was conducted in the state codes in LEXIS. Permitting and renewal information was identified for 20 states (the current codes for 30 states are presently available in LEXIS).

States issue prospecting or mining permits for periods anywhere from one to 20 years. There is a similar diversity among the states in the term of renewed permits, renewal fees and the administrative and reporting requirements attached to the renewal procedures. Copies of the statues and regulations identified are attached for your review.
