Library of COALEX Research Reports

COALEX Research Reports are the products of research and analysis conducted on specific issues relating to the regulation of Surface Mining Control and Reclamation Act of 1977. The research is conducted in response to requests for information from State Regulatory Authorities, under a cooperative agreement between the Office of Surface Mining (OSM) and the Interstate Mining Compact Commission (IMCC).

COALEX refers to the Library of Surface Mining Materials maintained by OSM in LEXIS-NEXIS and is a major source for the research.

TOPICS: STATUS OF REMINING BILLS

INQUIRY: What is the status of the remining bill introduced by Representative Rahall at the beginning of this year? Is there any information available on two earlier versions of remining bills introduced by Representatives Clinger and Boucher?

SEARCH RESULTS: Research was conducted using the bill tracking materials available in LEXIS. A summary of actions on the bills follows. Copies of the "Bill Tracking Reports" and both versions of the Rahall bill are attached.


SUMMARY OF ACTIONS

1. Earlier bills.

In June, 1989 (101st Cong, 1st Sess), two bills were introduced and referred to the House Interior and Insular Affairs Committee. The purpose of the bills was "to encourage the remining and reclamation of abandoned mined lands by active mining operations."

HR 2719 was introduced by William F. Clinger (R-PA).

HR 2791 was introduced by Rick Boucher (D-VA).

The House Subcommittee on Mining and Natural Resources held a hearing on both bills in July, 1989.


2. Coalfield Environment Enhancement Act of 1990.

The result of the hearing and "subsequent work on this matter" was the introduction of HR 4053 in February, 1990 (101st Cong, 2nd Sess). Introduced by Nick J. Rahall (D-VW), the bill is cosponsored by the following Representatives:

Boucher (D-VA)
Clinger (R-PA)
Murphy (D-PA)
McCloskey (D-IN)
Udall (D-AZ)

The House Subcommittee on Mining and Natural Resources held a hearing on the bill on March 13, 1990. On April 26, 1990, the Subcommittee approved an amended version of the bill for full Committee action. The House Interior and Insular Affairs Committee voted unanimously for the amended bill on May 16, 1990.

On June 6, 1990, HR 4053, with an amendment, was reported in the House (H Rept 101-527).
