Library of COALEX Research Reports

COALEX Research Reports are the products of research and analysis conducted on specific issues relating to the regulation of Surface Mining Control and Reclamation Act of 1977. The research is conducted in response to requests for information from State Regulatory Authorities, under a cooperative agreement between the Office of Surface Mining (OSM) and the Interstate Mining Compact Commission (IMCC).

COALEX refers to the Library of Surface Mining Materials maintained by OSM in LEXIS-NEXIS and is a major source for the research.

INQUIRY: Conduct a search of the legislative history of P.L. 95-87, Sec. 701.9 (Definition of Indian Lands) and Sec. 710 (Indian Lands Study). Include in the search: Congressional intent and floor debate; applicable reports; the sequence of any changes applied to these sections.

September 13, 1979, the Council of Energy Resource Tribes (CERT) produced a report for the Office of Surface Mining (OSM) which included a study of the legislative history of SMCRA with regard to the regulation of surface mining and reclamation on Indian lands. (The Control and Reclamation of Surface Mining on Indian Lands, Report by the Council of Energy Resource Tribes, Contract #J5180108 (September 30, 1979))

In a telephone conversation with Ms. St. Peter, it was decided that the CERT-OSM Indian Lands Study would most probably provide the needed information. A copy of the study's Appendix G, "Legislative History of the Surface Mining Control and Reclamation Act of 1977 Regarding the Regulation of Surface Mining and Reclamation on Indian Lands", has been enclosed. A follow-up COALEX search will be conducted to augment any areas not sufficiently covered.

A search was done to identify the legislative history documents in COALEX that specifically cite Indian lands. Citation lists for the retrieved documents are attached.
